We identify several severity-related trends in UM/UIM law across the states, several of which resolve issues in a manner favorable to insurers. The article includes strategies from two Florida attorneys that can be successfully utilized to provide the greatest protection to an insured, while at the same time minimizing an insurance carrier's exposure to allegations of bad faith claims handling.
